Houseworx Terms and Conditions
Acceptance of Proposal:
Any alterations or deviations from the above specifications that involve additional costs will only be carried out upon written change orders and will result in an additional charge for needed labor and materials. All agreements are subject to contingencies beyond our control. Prices are valid for no more than fourteen (14) days.
Payment Deposit & Progress Invoices:
For Projects under $20,000, a 50% deposit is required to initiate the agreed-upon work. An additional 25% is due when the project reaches 50% completion, with the final balance payable upon full completion of the work.
For projects over $20,000, a 25% deposit is required upon acceptance of estimate & Signing of contract. Semi-Monthly draws will be invoiced for work completed by the 5th & 20th of each month. Invoices for draws are due by the 10th & 25th of each month for draws invoiced.
The cost of all materials needed for a change order will need to be paid up front and any change order over $5,000 will require a 50% deposit.
A late fee of 1.5% may be applied at the owner's discretion for any payments that are overdue by 5 days.
Adjustments to this policy may be made in unique situations or at the owner's discretion.
Change Orders:
Any changes to the scope of work must be documented in a written change order and signed by both the contractor and the client. The change order will detail the additional cost and time required to complete the changes.
Warranties and Guarantees:
Houseworx Construction Inc warrants that all work will be performed in a workmanlike manner and will conform to the standards of the industry. Houseworx Construction Inc will repair or replace any defective work at no cost to the client for a period of 730 days from the date of project completion.
Liability and Insurance:
Houseworx Construction Inc will carry appropriate insurance coverage, including general liability and workers' compensation insurance.
Houseworx Construction Inc is not liable for any damage arising from the use of the property during construction.
Permits and Approvals:
Houseworx Construction Inc is responsible for obtaining all necessary permits and approvals for the work.
Any fees associated with permits and approvals will be included in the total cost unless otherwise specified.
Termination Policy:
Either party may terminate this agreement with 30 days written notice. In the event of termination, the client will pay the contractor for all work completed up to the date of termination, including any materials purchased for the project including project management fees.
Dispute Resolution:
Any disputes arising from this agreement will be resolved through mediation. If mediation fails, the parties agree to submit the dispute to binding arbitration.
Governing Law:
This agreement will be governed by and construed in accordance with the laws of the State of Washington.
